These Terms of Service (“Terms”) govern your access to and use of the website https://ividentia.com and any application operated by IVIDENTIA on third-party platforms, including Meta (Facebook, Instagram) and LinkedIn (together, the “Website”).
By accessing the Website you accept these Terms. If you do not accept them, do not use the Website.

This is the most important provision of these Terms. Please read it carefully.
IVIDENTIA provides digital forensics, audiovisual forensics and technical audit services, acting as a court-appointed expert (perito judicial), as a party-appointed technical assistant (assistente técnico) and as a private technical consultant.
Accordingly:
2.1 Content published on the Website — including articles, technical notes, case discussions, methodological explanations and downloadable material — is provided for general informational purposes only. It does not constitute a technical opinion, an expert report, a laudo pericial, a parecer técnico, legal advice, or a recommendation applicable to any specific situation.
2.2 No expert engagement, consultancy relationship or professional retainer of any kind is created by your use of the Website, by submitting the contact form, by subscribing to the newsletter, by interacting with our content on social platforms, or by any correspondence exchanged before a written engagement instrument is executed by both parties.
2.3 An engagement with IVIDENTIA begins only upon execution of a written instrument specifying scope, methodology, deliverables, timeline and fees, or upon formal judicial appointment and acceptance of that appointment in the case record.
2.4 Nothing on the Website should be relied upon as a substitute for a technical examination of your specific material. Technical conclusions depend on the evidence actually examined, on its integrity, and on the conditions under which it was obtained. General content cannot account for those variables.
2.5 Do not send confidential, privileged or evidentiary material through the Website. Material submitted through the contact form or by unsolicited email is not treated as subject to a chain of custody, is not covered by an engagement, and may not be protected by professional confidentiality obligations that arise only from a formal engagement. Contact us first so that a secure and documented channel can be established.
You may browse the Website, read and share its content, and contact us. You may quote limited excerpts of our published content for commentary, study or reference, provided you attribute the source to IVIDENTIA and link to the original page.

All content on the Website — text, methodological descriptions, diagrams, graphics, layout, source code and the IVIDENTIA name and visual identity — is owned by IVIDENTIA or used under licence, and is protected by Brazilian Law nº 9.610/1998 and applicable international treaties.
The permitted quotation described in Section 3 does not transfer any ownership or licence beyond that specific use.
Expert reports, technical opinions and deliverables produced under an engagement are governed by the intellectual property clauses of the corresponding engagement instrument, not by these Terms.
The Website may link to third-party websites and operates applications on third-party platforms. We do not control those services and are not responsible for their content, availability, practices or terms. Your use of Meta and LinkedIn services is additionally governed by the terms and privacy policies of those platforms.
We aim to keep the Website available, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue any part of the Website at any time, including for maintenance, without prior notice and without liability.
To the fullest extent permitted by applicable law, the Website and its content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including as to accuracy, completeness, currency, fitness for a particular purpose or non-infringement.
Technical, legal and regulatory matters evolve. Content that was accurate when published may become outdated. We are under no obligation to update published content.
To the fullest extent permitted by applicable law, IVIDENTIA, its partners, employees and contractors shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profit, revenue, data or business opportunity, arising out of or in connection with your use of, or inability to use, the Website — including any decision taken in reliance on its content without a formal engagement.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, wilful misconduct, or damage caused to consumers under the Brazilian Consumer Protection Code (Law nº 8.078/1990) where that Code applies.
You agree to indemnify and hold IVIDENTIA harmless against any claim, loss or expense, including reasonable legal fees, arising from your breach of these Terms or your unlawful use of the Website.
Our processing of personal data is described in our Privacy Policy. Instructions for requesting deletion of your data are set out in our Data Deletion Instructions. Personal data contained in evidentiary material examined under an engagement is governed by our Confidentiality & Data Handling Statement.
We may amend these Terms at any time. The “Last updated” date indicates the current version. Material changes will be announced through a prominent notice on the Website. Continued use of the Website after a change takes effect constitutes acceptance of the amended Terms. If you do not accept them, discontinue use of the Website.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision does not constitute a waiver of that provision.
These Terms are governed by the laws of the Federative Republic of Brazil.
The parties elect the courts of the Judicial District of Brasília, Federal District, Brazil, as the exclusive forum for any dispute arising from these Terms, expressly waiving any other however privileged — save where mandatory consumer protection legislation or the mandatory jurisdictional rules of the user’s country of residence provide otherwise.
Nothing in this clause deprives a consumer resident in the European Union, the United Kingdom or another jurisdiction with equivalent mandatory rules of the protection of the courts of their place of residence.
